CertaIQ is an AI-assisted decision support tool. It is designed to support — not replace — the professional judgment of trained county board staff and investigative agents. All classifications must be reviewed by qualified personnel before action is taken.
1. Acceptance of Terms
By accessing or using CertaIQ at certaiq.com ("the Service"), you agree to be bound by these Terms of Use. If you do not agree to these terms, do not use the Service. These terms apply to all users of the Service, including individuals, organizations, and their staff.
2. Description of Service
CertaIQ is an AI-powered incident classification and compliance support tool designed for Ohio developmental disabilities organizations. The Service provides:
- AI-assisted MUI/UI incident classification based on OAC 5123-17-02 (effective July 1, 2025)
- Pre-filled incident report and appendix form generation
- Regulatory reference information
- Client notecard generation from behavior support plan documents
- Restraint and seclusion logging tools
- Policy intelligence question and answer functionality
3. Not a Substitute for Professional Judgment
CertaIQ is a decision support tool only. All outputs, including incident classifications, form pre-fills, and regulatory guidance, are AI-generated and must be reviewed by qualified personnel before action is taken. CertaIQ does not constitute legal advice, regulatory advice, or clinical advice.
When in doubt about any classification or compliance requirement, consult your supervisor, investigative agent, or legal counsel. Always treat ambiguous situations as MUI until confirmed otherwise by a qualified professional.
4. Accuracy and Currency of Information
CertaIQ's knowledge base reflects Ohio regulatory requirements as of July 1, 2025. While we strive to maintain current information, regulations change. Users are responsible for verifying that the regulatory framework reflected in CertaIQ remains current and applicable to their situation. CertaIQ is not responsible for any compliance failures arising from reliance on outdated information.
5. Data and Privacy
Please review our Privacy Policy for information about how data is handled. Important points:
- CertaIQ does not store incident data between sessions in the current version
- Incident descriptions and other information entered into the classification tool are transmitted to Anthropic's API for processing
- Do not enter full names, dates of birth, Social Security numbers, or other individually identifiable health information in the incident description fields
- Use initials, reference numbers, or general descriptors instead of identifying information
6. Acceptable Use
You agree to use CertaIQ only for lawful purposes and in accordance with these Terms. You agree not to:
- Use the Service for any purpose other than legitimate DD compliance work
- Share your access credentials with unauthorized persons
- Attempt to reverse engineer, copy, or reproduce the Service
- Use the Service in any way that violates applicable laws or regulations
- Enter sensitive personal health information in the classification tool fields
7. Intellectual Property
CertaIQ, including its software, design, content, and classification methodology, is the intellectual property of CertaIQ and its licensors. The regulatory source materials incorporated into CertaIQ's knowledge base are public Ohio administrative and statutory law. The CertaIQ system prompt, classification methodology, and interface are proprietary.
8. Limitation of Liability
To the fullest extent permitted by law, CertaIQ and its owners shall not be liable for any direct, indirect, incidental, special, or consequential damages arising from your use of the Service, including but not limited to compliance failures, regulatory penalties, or adverse outcomes arising from reliance on CertaIQ classifications.
The Service is provided "as is" without warranties of any kind, express or implied, including warranties of accuracy, completeness, fitness for a particular purpose, or non-infringement.
9. Organization Responsibility
Organizations deploying CertaIQ for staff use are responsible for:
- Ensuring staff understand that CertaIQ is a support tool requiring human review
- Training staff on the limitations of AI-assisted classification
- Maintaining their own compliance policies and procedures
- Reviewing and validating all CertaIQ outputs before official action is taken
- Ensuring their use of CertaIQ complies with applicable privacy laws including HIPAA and FERPA
10. Modifications to Terms
CertaIQ reserves the right to modify these Terms of Use at any time. Changes will be posted at this URL with an updated effective date. Continued use of the Service after changes are posted constitutes acceptance of the modified terms.
